Quick answer: In Toronto, you do not need a tent permit (a building permit) for a party tent on private property as long as the tent (or group of tents) covers no more than 60 square metres (646 sq ft), is not attached to a building, and stands more than 3 metres (about 10 ft) from every other structure. Break any one of those three rules and a permit is required. Tents in City parks always need permission from the City, whatever their size.
This is one of the questions we hear most when people book a tent, and the honest answer is that most backyard tents are fine, but a couple of details catch people out. Here is how the rules work in plain language, which of our tent sizes fall under the limit, and what changes if your party is in a park.

When Do You Need a Tent Permit in Toronto?
Tents fall under the Ontario Building Code, and the City of Toronto applies the same rules. A tent or group of tents is exempt from a building permit only when all three of these are true:
- The total ground area is 60 square metres (646 sq ft) or less.
- The tent is not attached to a building.
- The tent is set up more than 3 metres (about 10 ft) from all other structures.
Two or more tents set up within 3 metres of each other count as one group, so their areas get added together. Two 20 x 20 ft tents side by side are 800 sq ft in total, which is over the limit even though each tent on its own is not.
The same Ontario Building Code applies across the province, so the 60 square metre rule also applies in Mississauga, Brampton, Vaughan, Markham and the rest of the GTA.
Which Tent Sizes Need a Permit?
Here is how our frame tents compare with the 646 sq ft limit:
| Tent size | Area | Over the 646 sq ft limit? | Fits about |
|---|---|---|---|
| 10 x 10 ft | 100 sq ft | No | 10 to 12 guests |
| 10 x 20 ft | 200 sq ft | No | Up to 20 guests |
| 20 x 20 ft | 400 sq ft | No | Up to 40 guests |
| 20 x 30 ft | 600 sq ft | No, but close | Up to 60 guests |
| 20 x 40 ft | 800 sq ft | Yes | Up to 80 guests |
So a single 20 x 30 ft tent is the largest size we carry that stays under the area limit on its own. If you need room for more than about 60 people, a 20 x 40 ft tent or two tents set up close together will push you into permit territory. Prices for each size are in our tent rental cost guide.
The 3 Metre Rule Most People Miss
Area is the rule everyone knows. Distance is the one that trips people up. Even a small tent needs a permit if it is attached to your house or set up within 3 metres of another structure, like the house, a garage or a shed.
In a lot of Toronto backyards, especially narrow lots in East York, the Danforth and Leslieville, there is not much room to spare. Before you book, measure your yard and check whether the tent can sit at least 3 metres away from the buildings on your lot. Remember to count the space for stakes or weights around the edges, not just the tent roof.
If the only spot that fits is right against the back of the house, you have two choices: go with a smaller tent that fits further out, or contact Toronto Building about a permit before your event.
Do You Need a Permit for a Tent in a Toronto Park?
Yes. Parks have their own rules on top of the Building Code:
- Tents need City permission. The Toronto parks bylaw does not allow anyone to put up a tent or structure in a park unless it is authorized by permit.
- Groups over 25 need a permit. A picnic, organized gathering or event for more than 25 people needs a permit from the City.
- Big tents need a building permit too. Any tent over 646 sq ft in a park also needs a permit from Toronto Building, and the City wants to know your tent stakes will not hit underground utility lines.
- Special events need insurance. Larger special events in parks require a $2 million liability insurance certificate naming the City of Toronto.
If you are planning a park party in Scarborough or anywhere else in the city, sort out the park permit first, then book your rentals for the confirmed date and spot.
Other Tent Safety Rules to Know
- Keep flames away. Set up barbecues, grills, fire pits and heaters well away from the tent walls and roof.
- Watch the wind. We anchor every tent to suit the ground and the forecast. If strong winds are expected, we will talk with you about the safest plan before setup.
- Keep exits clear. Do not block the open sides of the tent with tables, coolers or decor, so people can get out quickly if they need to.
- Use proper weights on hard ground. On driveways and patios where stakes cannot go in, we secure the tent with weights instead.
